Community Advisory Committee Resolution No. 8 - 27 - 03
Pursuant to
Suffolk County Code Section 380 - (E), Concerning a Special Use Exemption Request by the Suffolk County Department of Public Work Operations and Maintenance for the Use of Pesticides In and Around County Buildings

WHEREAS, the Suffolk County Department of Public Works Operations and Maintenance represent 317 buildings in the County and eighty-nine of these are provided with monthly maintenance by contracted Pest Control Operators; and

WHEREAS, pest infestations result in risk to human health posed by disease and allergies and financial considerations resulting in damage to the facility and integrity of the structure; and

WHEREAS, the Department of Public Works Operation and Maintenance has submitted an application for a special use exemption for the use of pesticides on an emergency basis, attached hereto as Exhibit "A" and incorporated by reference; and

WHEREAS, on June 5th, June 25th, July 23rd and August 27th, 2003, presentations were received by Joyce Rodler, Cornell Cooperative Extension Suffolk County and Robert Frevele, Department of Public Works regarding the need for this Special use Exemption; and

WHEREAS, Best Pest Management practices, such as sanitation, exclusion, monitoring control many pest problems, there are buildings possessing a zero tolerance to pests; and

WHEREAS, the use of pesticide products is sometimes necessary using least toxic products first; and

WHEREAS, the Department of Public Works Operation and Maintenance in the Annual Requirements Contract for Exterminating for the County, Section #1 under General Specifications under Personnel, specifically states that the contractor shall provide only qualified pest management personnel with adequate experience in the conduct of IPM (Integrated Pest Management) programs; and

WHEREAS, Cornell Cooperative Extension Suffolk County in cooperation with DPW Operations and Maintenance, performs on-site evaluations, pest identification, makes recommendations, demonstrates the use of minimum risk products, procedures and performs minor building modifications; and

WHEREAS, Local Law 3-2002 was previously reviewed under the State Environmental Quality Review Act ("SEQRA"); and

WHEREAS, by separate resolution, dated August 27, 2003, under the State Environmental Quality Review Act ("SEQRA"), N.Y. Envtl. Conserv. Law Art. 8, the CAC has determined that this action is a Type II action, pursuant to Volume 6 of New York Code of Rules and Regulations ("NYCRR") 617.5©(20) and (27), in that the resolution pertains to routine or continuing agency administration and management, not including new programs or major reordering of priorities that may affect the environment; now

Be it therefore

RESOLVED, that a one year Special Use Exemption, pursuant to Suffolk County Code Section 380-5(E), be granted to the Suffolk County Department of Public Works for the use of select pesticides in and around County Buildings in the event that a pest infestation occurs that would inflict public injury, adverse health impacts or irreparable structural damage ; and, be it further

RESOLVED, that this exemption is granted with the following conditions:

1. Only those pesticides on the attached list, dated August 26, 2003, may be used, unless the pesticide product is already exempt under the law; and

2. Prior to the use of listed pesticides, approval must be obtained from DPW Operations and Maintenance; and

3. In the event that a serious pest infestation occurs and a pesticide on the attached list is the only control option, DPW will notify the Chair of the Community Advisory Committee of the treatment. The following information will be provided to the Community Advisory Committee; the pest, building location, the product used and possible repercussions if treatment were not undertaken. A follow-up letter will be prepared by DPW and presented at the next Community Advisory Committee meeting; and

4. DPW, along with Cornell Cooperative Extension Suffolk County, will conduct a meeting with County contracted Pest Control Operators to review the requirements of this Special Use Exemption in order to promote compliance with Suffolk County Code Chapter 380; and

5. Cornell Cooperative Extension Suffolk County and the contracted Pest Control Operators will continue to test minimum risk products and methods, and those showing favorable results will be substituted for pesticide products on the attached list.

RESOLVED, that following the one year time period, a renewal request may be submitted; and, be it further

RESOLVED, that this Resolution shall take effect September 15, 2003.
